The Chicago Sun Times recently reported that a man in his 40s had a slip and fall accident on the northbound tracks at the Howard Station in Chicago. For anyone who has ever ridden the CTA (Chicago Transit Authority) trains, this type of slip and fall injury is more common than you would think. Some of the stations are above ground and can be especially treacherous during the winter when ice and snow covers waiting areas.
Trains were delayed for about 15 minutes while firefighter crews removed the man from the tracks. He man was taken to a nearby hospital in “stable,” but serious condition. Could this man have a lawsuit against the CTA? What kind of accidents can result in slip and fall settlements?
Slip and Fall Law Explained
A slip and fall injury is a person slips, trips or falls as a result of a dangerous, harmful or unsafe property. A slip and fall accident can happen on private or public property (like the CTA). Slip and fall accidents usually happen in busy places such as shopping centers, grocery stores, retail stores, sidewalks, or train stations. Most slip and fall injuries are a direct result of water, rain, ice, snow, grease or other slippery substance on a surface, such as a train station platform.
Slip and fall injuries are under what is called “premises liability,” which is the legal responsibility that a landowner and occupiers of a property have for injuries and accidents that occur on their property. In this case, the CTA is responsible for their property, and in the winter that mean keeping the train platforms shoveled and safe for passengers.
When to Call a Slip and Fall Injury Attorney Los Angeles
Premesis liability is not just the property itself, someone could also have a lawsuit if they were injured because of equipment on the property; if this man had been run over by a train while on the tracks. Another claim could filed if someone on the property caused injury to the victim. What if this man had been mugged or pushed onto the tracks and there wasn’t adequate security, that might be another claim.
