Tamara Wait, of Madison County, Illinois, is suing a Granite City, Illinois Wal-Mart and its manager, Christopher Soltor, after she suffered a slip and fall accident on the store’s bathroom floor.
Wait says she was a customer of the Wal-Mart in June and was using the handicapped stall nearest the front of the women’s restroom when she slipped and fell because of a wet substance on the floor. According to her slip and fall lawsuit Wait says, “she injured her back, elbow and leg in the fall”.
Wait accuses the store and its manager, Soltor, of negligence for allowing a substance to accumulate on the bathroom floor. She is asking for more then $100,000 in damages for medical expenses, lost wages and court costs.
Wal-Mart has a long history of exposing customers to dangerous conditions, including potholes in parking lots, numerous injuries caused by falling objects inside its retail stores personal injury accidents.
Will Wait succeed? She will need to prove that a store’s owner or employees either knew about the danger in the bathroom and didn’t take timely action to fix it or warn customers, or that the bathroom danger was there for a long enough time that the store’s owner or employees should have known about it.
