4,600 outdoor playsets were recently recalled by U.S. Consumer Product Safety Commission (CPSC) and the manufacturer, Escalade Sports. The defective product recall was due to the fall hazards that the product poses. The CPSC announced the recall on February 8, 2011.
This defective product recall was initiated after swing sets on the playset were found to crack and break in half, which could cause a child to fall. Specifically, this defective product recall involves belt-style swing seats on four models of Oasis Playsets: PG01W, PG02W, PG03W and PG04W.
Product Recall Model Numbers
The model numbers of these playsets are located on a plate on the swing’s horizontal beam. According to a CPSC press release: “The green plastic seats are about 26 inches long and are hung from green, plastic-coated chains. The swing seats have rounded ends with black grommets on each end.”

What Exactly Is a Defective Product?
A defective product causes some injury or damage to a person as a result of some flaw or weakness in the product, its labeling, or the way the product was used. The manufacturer of the product that caused the injury, as well as those involved in the chain of commerce, are often liable for injuries caused by defective products.
All states allow some form of recovery to persons injured by defective products. These “product liability” claims are cases dealing with damage due to defective products that run from the obvious (a swing set that falls apart) to the not-so-obvious (exposure to high radiation from a cellular phone).
